KcCakelady TERMS OF SERVICE AGREEMENT
Policy & Terms of Agreement
Acceptance of a quote, payment of a retainer, or reservation of an event date constitutes acknowledgment and acceptance of these Terms and Conditions in their entirety. All policies are non-negotiable.
KcCakelady is a fully insured sole proprietorship offering delivery and limited pickup services as described below.
PRICING, RETAINERS AND PAYMENTS
A nonrefundable retainer equal to fifty percent (50%) of the total order is required to reserve an event date.
The remaining balance is due no later than thirty (30) days before the original event date. Once paid, the final balance is nonrefundable and nontransferable.
Final flavor selections and delivery details must be provided no later than thirty (30) days before the event.
Failure to make the final payment by the due date may result in cancellation of the order and forfeiture of all amounts paid.
Prices are subject to change until the required retainer has been received and the event date has been reserved.
CANCELLATIONS
All cancellation requests must be made by the contracting client who placed the order.
Cancellations made more than thirty (30) days before the event may be eligible for a refund of amounts paid in excess of the initial nonrefundable retainer.
Cancellations made within thirty (30) days of the event are not eligible for a refund.
ORDER, DATE AND VENUE CHANGES
Clients should initially reserve the minimum number of servings needed. Additional servings may be added up to thirty (30) days before the event, subject to availability and applicable price adjustments.
One (1) date and/or venue change is permitted without an additional change fee, subject to availability. The client remains responsible for any increased costs resulting from the new date, venue, delivery requirements, serving count or design.
Additional date or venue changes may result in added fees, which will be due when the requested change is approved. Repeated changes may also result in cancellation of the order.
Changes requested within thirty (30) days of the event may not be accommodated and may result in forfeiture of amounts paid.
CUSTOM DESIGN POLICY
All cakes are individually handcrafted works of edible art.
KcCakelady will make every reasonable effort to reflect approved inspiration photographs, sketches and design concepts. However, variations in color, artistic interpretation, handcrafted decorations, sculpting, florals, airbrushing and other design details are inherent in custom work. Such variations do not constitute a defect or grounds for a refund.
Quotes include the decorated cake only. Fresh flowers, cake stands, toppers, rentals and other accessories are not included unless specifically listed in writing.
DELIVERY, SETUP AND TRANSFER OF RESPONSIBILITY
KcCakelady will photograph the cake after setup to document its appearance and condition at the time of delivery. Because the contracting client may not be present, these photographs will serve as proof of delivery and condition.
Responsibility for the cake transfers to the client once delivery and setup are complete.
The client is responsible for providing a safe environment with reasonable temperature and humidity conditions. Buttercream and edible decorations are sensitive to heat, humidity, direct sunlight, outdoor conditions, open-air barns and venues, and other environmental factors beyond KcCakelady’s control. Outdoor display is not recommended.
KcCakelady is not responsible for weather-related damage or changes that occur after delivery.
Cakes must never be placed on or near appliances, heat sources, speakers, unstable surfaces, or areas exposed to vibration, movement or excessive handling.
CONCERNS AND REFUND REQUESTS
Concerns regarding the cake’s quality, freshness, flavor, appearance, condition or delivery must be reported directly to KcCakelady as soon as possible, but no later than twenty-four (24) hours after delivery.
Only the contracting client may discuss order details, submit a complaint, request a refund, or negotiate compensation.
Clients are encouraged to contact KcCakelady directly before publishing a review or public comment so there is a reasonable opportunity to address the concern.
To allow for a fair evaluation, the cake and any remaining portions must be preserved in their original condition whenever reasonably possible. Cutting, serving, sampling, altering, transporting, excessively handling, discarding or otherwise making the cake unavailable before review may limit or prevent evaluation of a claim.
KcCakelady is not responsible for costs associated with returning a cake or any remaining portions.
All refund requests must:
• Be submitted in writing by the contracting client.
• Be received within twenty-four (24) hours of delivery.
• Include photographs and any other reasonably requested documentation.
• Include the return of all unused cake and remaining portions for inspection.
No refund will be issued for a cake that has been fully or substantially consumed, discarded, destroyed, altered, disposed of, or otherwise made unavailable for inspection.
Handling or alteration of the cake by the client, guests, vendors or other third parties before inspection may limit or void a refund claim.
Taste and flavor preferences are subjective and do not constitute grounds for a full refund.
Refund requests are reviewed individually based on the available facts, documentation and returned product. Any approved refund will be limited to a maximum of fifty percent (50%) of the cake’s purchase price.
Please allow up to forty-eight (48) hours after receipt of all requested information and returned product, when applicable, for a decision.
EMERGENCIES AND CIRCUMSTANCES BEYOND OUR CONTROL
KcCakelady shall not be liable for a delay or inability to perform caused by circumstances beyond reasonable control, including but not limited to accidents, serious illness, hospitalization, severe weather, acts of God, government actions or other unforeseen emergencies.
Every reasonable effort will be made to arrange an appropriate alternative when possible.
If fulfillment becomes impossible and alternative arrangements cannot reasonably be made, amounts paid for the unfulfilled order will be refunded.
CLIENT RESPONSIBILITIES, ALLERGENS AND INTERNAL SUPPORTS
The client acknowledges that fresh flowers are not food products and may come into contact with cake surfaces.
Products may contain or come into contact with eggs, dairy, wheat, soy, peanuts, tree nuts and other allergens. KcCakelady cannot guarantee an allergen-free environment.
Many cakes contain internal support materials, including dowels, rods, wires, picks and other non-edible components. These items must be located and removed before the cake is served or consumed.
Do not push or smash anyone’s face into a cake. KcCakelady assumes no responsibility for injuries caused by internal supports, non-edible decorations, misuse or improper handling.
PICKUP ORDERS
Pickup is available only for cakes of three (3) tiers or fewer and must be approved in advance.
A mutually agreed-upon pickup time and location will be arranged.
If the client is more than fifteen (15) minutes late, fails to appear, or requires KcCakelady to make an additional trip, a $20 fee must be paid before the cake is released.
At pickup, the client is responsible for inspecting the cake. Acceptance of the cake confirms that it meets the agreed-upon expectations and is in satisfactory condition.
Once the cake leaves KcCakelady’s possession, the client assumes all responsibility and liability for its transportation, storage, setup, handling and condition.
CAKE STANDS, TABLES, TOPPERS AND DECORATIONS
All cakes are delivered on sturdy cake drums unless otherwise specified in writing.
Any cake stand, pedestal, table or display structure supplied by the client or venue must be level, stable, structurally sound and capable of safely supporting the cake’s weight.
KcCakelady is not responsible for damage caused by inadequate tables, stands, displays or flooring, or by movement, vibration or setup performed by others.
Cake toppers should generally be six (6) inches or smaller unless approved in advance.
Flowers or decorations supplied by the client must be present on the cake table when KcCakelady arrives for delivery and setup. KcCakelady is not responsible for items that are missing, late or unsuitable for use.
PHOTOGRAPHY RELEASE
Unless otherwise agreed in writing, KcCakelady reserves the right to photograph completed cakes and use those images for its portfolio, website, social media, advertising, publications, competitions and other promotional purposes.
POLICY UPDATES
KcCakelady reserves the right to update or revise these Terms and Conditions at any time without prior notice.
The Terms and Conditions in effect on the date the retainer is received will govern that order and remain in effect regardless of subsequent policy revisions.
