KCCAKELADY TERMS & SERVICE AGREEMENT
PRICING & DEPOSITS
Payments, Acceptance of a quote and reservation of an event date constitutes acknowledgment and acceptance of these Terms and Conditions in their entirety. All policies are non-negotiable.
KcCakelady is a fully insured, delivery-only sole proprietorship.
Final flavor selections and delivery details must be provided no later than two (2) weeks prior to the event date.
A non-refundable 50% retainer of the total order amount is required to reserve an event date.
The remaining balance is due no later than thirty (30) days prior to the original event date and becomes non-refundable and non-transferable once paid.
Any cancellation request must be made by the contracting client who placed the order.
Cancellations made more than thirty (30) days prior to the event date may receive a refund of any monies paid in excess of the initial non-refundable retainer.
Cancellations made within thirty (30) days of the event date are not eligible for any refund.
Failure to make final payment by the due date may result in cancellation of the order and forfeiture of all monies paid.
All prices are subject to change until a retainer has been received and the event date reserved.
CHANGES
Clients should initially reserve the minimum number of servings needed. Additional servings may be added up to thirty (30) days prior to the event date, subject to availability and pricing adjustments.
One (1) date and/or venue change is permitted at no charge, subject to availability. Any increase in pricing resulting from the new date, venue, delivery requirements, or design changes shall be the responsibility of the client.
More than one date and/or venue change may result in additional fees due at the time of the request and may be subject to cancellation of the order. Any monies paid may be forfeited if changes are requested within thirty (30) days of the event date.
CUSTOM DESIGN POLICY
All cakes are custom works of edible art and are individually handcrafted.
While every effort is made to closely match inspiration photos, sketches, and design concepts, slight variations in color, artistic interpretation, hand-crafted decorations, sculpting, florals, airbrushing, and other design details may occur and shall not constitute a defect or basis for a refund.
Quotes are for decorated cakes only and do not include fresh flowers, cake stands, toppers, rental items, or other accessories unless specifically stated in writing.
DELIVERY & REFUND POLICY
KcCakelady will take photographs upon completion of setup as proof of delivery and condition at the time of delivery.
In many cases the client may not be present at the time of delivery. Photographs taken at delivery shall serve as documentation of the cake's appearance and condition when delivered.
Once the cake has been delivered, responsibility for the cake transfers to the client.
It is the CLIENT'S responsibility to ensure the cake is maintained in a safe environment with reasonable temperature and humidity conditions.
Buttercream and edible decorations are sensitive to heat, humidity, direct sunlight, outdoor conditions, open-air barns & venues, and other environmental factors beyond KcCakelady's control. Outdoor display is not recommended. KcCakelady is not responsible for weather-related damage or changes occurring after delivery.
Cakes should never be placed on or near appliances, heat sources, unstable surfaces, speakers, or areas subject to vibration, movement, or excessive handling.
If a client has concerns regarding quality, freshness, flavor, appearance, or condition of the cake, clients are asked to contact KcCakelady directly before posting reviews or comments so concerns may be addressed.
Any concerns must be reported directly to KcCakelady as soon as possible, no later than 24 hrs from delivery.
Any concerns regarding the quality, flavor, freshness, appearance, condition, or delivery of the cake must be communicated directly by the contracting client.
KcCakelady will discuss order details, complaints, refund requests, and compensation matters only with the contracting client.
To ensure a fair evaluation of any concern, the cake and any remaining portions should be preserved in their original condition whenever possible until KcCakelady has had an opportunity to review the matter. Alteration, disposal, excessive handling, or consumption of the cake prior to review may limit the ability to evaluate a claim and may affect refund consideration.
KcCakelady is not liable for any return fees
All refund requests must:
• Be submitted in writing by the contracting client.
• Be submitted within twenty-four (24) hours of delivery.
• Include return of any unused cake for inspection.
Refund requests are limited to a maximum of fifty percent (50%) of the purchase price.
No refunds will be issued for cakes that have been fully consumed, substantially consumed, discarded, destroyed, altered, disposed of, or made unavailable for inspection.
Alteration, cutting, serving, sampling, removal, disposal, transportation, or handling of the cake by clients, guests, vendors, or third parties prior to inspection may limit or void any refund claim.
Taste and flavor are subjective matters and do not constitute grounds for a full refund.
KcCakelady will review all refund requests and supporting information. Please allow up to forty-eight (48) hours from receipt of all requested information and returned product, if applicable, for a decision regarding any refund request.
Any refund consideration will be determined after review of the facts, supporting documentation, and inspection of any returned product.
EMERGENCY
KcCakelady shall not be liable for delays or inability to perform due to circumstances beyond reasonable control, including but not limited to accidents, illness, hospitalization, acts of God, government actions, or other unforeseen emergencies.
Every reasonable effort will be made to arrange alternative accommodations when possible.
If fulfillment becomes impossible and alternative arrangements cannot be made, a refund of monies paid will be issued.
RESPONSIBILITIES & ALLERGENS
The client acknowledges that fresh flowers are not food products and may come into contact with cake surfaces.
Products may contain or come into contact with eggs, dairy, wheat, soy, peanuts, tree nuts, and other allergens.
Many cakes contain internal support structures including dowels, rods, wires, picks, or other non-edible components that must be removed before consumption.
DO NOT smash faces into cakes. KcCakelady assumes no responsibility for injuries resulting from cake supports or improper handling.
PICKUP ORDERS
Pickup is available only for cakes three (3) tiers and smaller.
A mutually agreed upon pickup time and location will be arranged.
If the client is more than fifteen (15) minutes late or fails to appear for pickup and an additional trip is required, a $20 fee will be due before the cake is released.
Upon pickup, the client acknowledges that the cake has been inspected, accepted, and meets expectations.
Once the cake leaves KcCakelady's possession, the client assumes all liability and responsibility for transportation, storage, setup, handling, and condition of the cake.
CAKE STANDS, TABLES & DECOR
All cakes are delivered on sturdy cake drums unless otherwise specified.
If the client elects to use a cake stand, pedestal, or display structure, it must be level, stable, structurally sound, and capable of supporting the weight of the cake.
KcCakelady is not responsible for damage resulting from inadequate tables, stands, displays, flooring, movement, vibrations, or improper setup by others.
Cake toppers should generally be six (6) inches or smaller unless otherwise approved.
Any flowers provided by the client for placement on the cake must be present on the cake table at the time of delivery.
PHOTOGRAPHY RELEASE
KcCakelady reserves the right to photograph and use images of all cakes for portfolio, website, social media, advertising, publication, competition, and promotional purposes unless otherwise agreed to in writing
*POLICY CHANGES
KcCakelady reserves the right to update, modify, or revise these Terms and Conditions at any time without notice.
The Terms and Conditions in effect on the date a retainer is received shall govern that order and shall remain in effect for that order regardless of any future policy revisions.
